Transport Asset Holding Entity of New South Wales / Provision of Static Security Services to RailCorp - 07/04001

Introduction

Rail Corporation New South Wales (RailCorp) is inviting tenders for a Period Contract (for the Term described below) for the provision of static security services to RailCorp.

The security services are required at various RailCorp facilities at locations generally within the CityRail Network to protect its essential assets, customers & employees. 

The security services are required at various times over a 24 hour period per day and 7 days per week. 

The security services required are unarmed security guards to patrol Railway Stations and other areas required by RailCorp.

Separate Contract for the Regions

The CityRail Network is divided into two regions - North and South. RailCorp shall award two separate Contracts for two Regions and only one Region shall be awarded to a successful Tenderer. In the event a successful Tenderer is short listed for both the Regions, the Tenderer shall rank in Schedule B2.1 their preference for the Regions.

Commencement and Term of the Contract

Following an Implementation Period, during which time the successful Tenderer is required to establish resources, facilities and management systems, the Services are scheduled to commence on 1 March 2008.

The Term of the Contract is for 3 years from commencement of the Services.  At the absolute discretion of RailCorp, the Contract may be extended for two additional 1 year periods. 

Pricing for the Services

Tenders are to be on a schedule of rates basis.  The schedule of rates is not subject to rise and fall for the initial 12 months from the commencement of the Services. 

Performance Standard

RailCorp requires a high standard of performance of the Services.  The Contract includes provisions for reduced payment for reduced performance. 

Tenderers are required to demonstrate in the methodologies submitted in their Tender that they can achieve the required performance standards. 

OHS&R

As the majority of the Services are to be performed in close proximity to operating trains, live overhead high voltage electrical wires and other areas of high safety risk, a high standard of OHS&R management will be required. 

Alcohol and Drugs

In accordance with section 42 of the Rail Safety Act 2002 (Act), RailCorp must ensure that all persons employed or contracted to perform railway safety work (as defined in the Act) are not under the influence of alcohol or any other drug when about to carry out, or while on duty for the purpose of carrying out (whether or not carrying out) railway safety work.

RailCorp may at any time arrange with an authorised officer of RailCorp for the random testing of any person undertaking railway safety work for the presence of alcohol and drugs in accordance with the provisions of the Rail Safety (Drug and Alcohol Testing) Regulation 2003 (Regulation).  It is an offence for a person to refuse to undertake a test if required by an authorised officer of RailCorp.

The successful tenderer shall ensure that all its employees engaged in the provision of the Services are familiar with the provisions relating to drugs and alcohol and drugs and alcohol testing in the Act and the Regulation and that those employees are alcohol and drug free and cooperate with RailCorp in administering these requirements.  Without limiting the clauses of the Contract the successful tenderer may be directed to have any person who is found to be under the influence of alcohol or drugs prevented from performing any of the Services under the Contract.

Under the Regulation, the prescribed concentration of alcohol is 0.02 grams or more of alcohol in 100 millilitres of blood.
